Terms of Service

1. Acceptance of Terms
By accessing or using HydLeads ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including businesses that subscribe to the Service ("Clients") and their end-users (e.g. patients visiting a Client's website).
2. Description of Service
HydLeads provides a multi-tenant website and practice management platform that allows Clients to create and manage a website, handle online bookings, collect patient enquiries, and send automated email communications. The platform is provided on a software-as-a-service basis.
3. Accounts and Onboarding
Client accounts are created by HydLeads on the Client's behalf. Clients are responsible for maintaining the confidentiality of their login credentials. You must notify us immediately of any unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation;
- Collect or process personal data without appropriate consent from data subjects;
- Send unsolicited commercial communications;
- Interfere with the security or integrity of the Service;
- Impersonate any person or entity.
- Comply with all Google Ads Policies, Terms of Service, and Developer Policies when utilizing any Google-integrated features provided by the Service;
5. Data and Privacy
Our collection and use of personal data is described in our Privacy Policy. As a Client, you are the data controller for your patients' personal data collected through the platform. We act as a data processor on your behalf. You are responsible for ensuring you have a lawful basis for processing patient data and for maintaining an appropriate privacy notice on your own site.
5a. Google API Integration and Third-Party Policies
The Service integrates with third-party platforms, including the Google Ads API. Your use of these features is strictly subject to the Google Ads API Terms of Service, Google Developer Policies, and Google's Advertising Policies. You agree that HydLeads is not responsible for any actions taken by Google against your account, including suspension or restriction, due to your management of advertisements or compliance violations through our platform.
6. Payment and Cancellation
Pricing is agreed between HydLeads and the Client prior to account creation. Billing terms, cancellation notice periods, and refund policies are set out in the individual agreement between HydLeads and each Client. In the absence of a separate agreement, subscriptions are billed monthly and may be cancelled with 30 days' written notice.
6a. Advertising Services (Google Ads)
Where a Client uses the advertising feature, HydLeads sets up and manages Google Ads campaigns on the Client's behalf through HydLeads's own Google Ads account. Every ad is subject to Google's review and policies, and HydLeads may pause or stop any campaign that breaches them or applicable healthcare advertising rules.
- No guarantee of results. Advertising can increase visibility, but neither HydLeads nor Google guarantees any number of visits, enquiries, patients, rankings or revenue.
- Budget. The Client chooses a daily budget; Google charges per click up to that budget. Ad spend and HydLeads's service fees are invoiced separately outside the dashboard.
- Content. The Client is responsible for the accuracy of the services, claims and landing page provided, and for complying with Google Ads policies and healthcare advertising rules.
- Reports. Performance figures come from Google Ads and the Client's website forms and may be revised by Google.
- Records. HydLeads keeps a record of the Client's acceptance of these terms and of the confirmations given for each campaign.
7. Intellectual Property
All software, design, and content forming part of the HydLeads platform remains the intellectual property of HydLeads. Content you upload to the platform (e.g. logos, page text, images) remains your property. You grant HydLeads a non-exclusive licence to host and display that content for the purpose of operating the Service.
8. Limitation of Liability
To the fullest extent permitted by law, HydLeads's liability to you in connection with the Service shall not exceed the total fees paid by you in the 3 months preceding the event giving rise to the claim. HydLeads is not liable for indirect, incidental, or consequential losses, including loss of data or business interruption.
9. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be communicated in advance where possible. We reserve the right to modify or discontinue any feature of the Service at any time.
10. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
11. Changes to These Terms
We may update these Terms from time to time. We will notify Clients of material changes via the email address associated with their account at least 14 days before changes take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
